Terms & Conditions

These terms govern your use of EchoWriting. By using the service you agree to them. Read them - they cover your account, your content, billing, and what happens if something goes wrong.

1. Acceptance

By accessing or using EchoWriting (the website, the web app, the public rewrite tool, or any related service we provide, together the "Service"), you agree to these Terms & Conditions ("Terms"). If you do not agree, do not use the Service.

You must be at least 13 years old to use the Service. If you are in the European Union or the United Kingdom, you must be at least 16, or have the consent of a parent or legal guardian. If you are using the Service on behalf of an organisation, you confirm you have authority to bind that organisation, and "you" in these Terms refers to that organisation.

2. The service

EchoWriting takes text you provide and produces a rewrite using large language models combined with style profiles you build (or choose from defaults). The Service is offered both to authenticated users (with an account) and through a public rewrite tool that may be used without an account.

Output is generated by probabilistic models. It can be inaccurate, repetitive, or surprising. We do not guarantee any specific result, including any specific outcome from third-party AI detectors, plagiarism checkers, or originality scoring tools.

3. Your account

Accounts are created via Google sign-in. One account per person. You are responsible for keeping control of your Google account and for everything done through your EchoWriting account, whether or not you authorised it.

4. Acceptable use

You agree not to:

  • Use the Service to create or distribute illegal, harmful, infringing, defamatory, or harassing content.
  • Submit content you do not have the rights to submit, including content owned by third parties.
  • Use the Service to evade academic-integrity systems or any policy or law that prohibits the use of AI-assisted writing in the context where you intend to publish.
  • Reverse-engineer, scrape, or attempt to extract our models, prompts, or training data.
  • Resell, sublicense, or share access to the Service.
  • Probe, attack, overload, or otherwise interfere with the Service or its security.
  • Use the Service to build a competing product.

We may suspend or terminate access if we reasonably believe you have breached this section, with or without notice depending on severity.

5. Your content & licence to us

You own the text, samples, knowledge documents, and other material you submit to the Service ("Your Content"), and you own the rewritten output produced for you. We claim no ownership over either.

To run the Service, you grant EchoWriting, Inc. a worldwide, non-exclusive, royalty-free licence to host, store, transmit, process, modify, and display Your Content, and to use Your Content to operate, secure, and improve the Service - including using it to train and refine the EchoWriting models. This licence ends for new uses when you delete Your Content from the Service, except where we are required to retain it for legal reasons or where it has already been incorporated into a model.

You confirm that you have all the rights necessary to submit Your Content - including, where relevant, third-party drafts, articles, knowledge documents, and writing samples you upload to build a preset.

6. AI output disclaimer

EchoWriting uses language models to generate text. You are solely responsible for reviewing the output before you use or publish it. We make no representation that any output:

  • is accurate, factual, or up to date;
  • is original or free of similarity with existing works;
  • will pass any specific AI-detection or plagiarism-detection tool;
  • is appropriate for any specific purpose, including academic, professional, regulatory, or commercial publication.

You are responsible for ensuring your use of any output complies with the rules of the venue where you publish it.

7. Subscriptions, billing, cancellation

Paid plans are charged through Stripe. By subscribing you authorise us, via Stripe, to charge your payment method for the plan you select on a recurring basis until cancelled.

You can cancel at any time. Cancellation takes effect at the end of your current billing period; you keep access to paid features until then.

No refunds. Except where required by law (including the Australian Consumer Law), we do not offer refunds, in whole or in part, for any subscription fee already paid, including for unused time on a plan after cancellation or downgrade.

We may change plan prices, features, or limits. We will give you advance notice in-app or by email before any change takes effect on your plan, and you can cancel before the change applies if you do not agree to it.

If a payment fails and we are unable to collect it, we may downgrade your account or suspend access until payment is restored.

8. Service changes & termination

We may add, change, or remove features, restrict access, or discontinue the Service at any time. We may also terminate or suspend your account if you breach these Terms, if required by law, or if we reasonably believe continuing your access creates risk for us or for other users.

You can stop using the Service at any time and request deletion of your account by emailing [email protected].

9. Intellectual property

EchoWriting's name, logos, software, models, prompts, design, and content are owned by EchoWriting, Inc. or its licensors and are protected by intellectual property laws. These Terms do not transfer any of those rights to you.

If you send us suggestions, ideas, or feedback about the Service, you grant us a perpetual, irrevocable, royalty-free licence to use them without obligation to you.

10. Disclaimers & limitation of liability

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted operation.

To the maximum extent permitted by law, EchoWriting, Inc., its officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or related to your use of the Service.

Where liability cannot be excluded, our aggregate liability for all claims arising out of or related to the Service is capped at the greater of (a) AUD 100, or (b) the amount you paid us in the twelve (12) months immediately preceding the event giving rise to the claim.

Australian Consumer Law. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law that cannot be lawfully excluded. Where we are entitled to limit liability for breach of a non-excludable guarantee in respect of services, our liability is limited, at our election, to re-supplying the services or paying the cost of having the services re-supplied.

11. Indemnity

You agree to indemnify and hold EchoWriting, Inc. harmless from any claim, loss, liability, or expense (including reasonable legal fees) arising out of (a) Your Content, (b) your breach of these Terms, or (c) your misuse of the Service. We will give you prompt notice of any such claim and let you control its defence at your expense, provided no settlement admits fault on our behalf without our written consent.

12. Governing law & disputes

These Terms are governed by the laws of Queensland, Australia, without regard to conflict-of-laws principles. The courts of Queensland, Australia have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Service, subject to any non-waivable right you have under the law of your home jurisdiction to bring proceedings in your local courts or to rely on mandatory consumer protections.

13. Changes to these terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. For material changes, we will give you reasonable notice in-app or by email. Continuing to use the Service after a change takes effect means you accept the updated Terms.
